Florida Statute 768.0706: Liability Protections for Multifamily Property Owners
Effective January 1, 2025, Florida Statute 768.0706 offers significant liability protections for multifamily residential property owners in Florida. The statute provides a presumption against liability for certain crimes committed on the premises by non-residents, such as intruders or vandals, if specific safety and security measures are implemented.

Who Does This Apply To?
The statute applies to multifamily residential properties, defined as buildings or groups of buildings with five or more living units on a single parcel of land, such as apartments, townhouses, or condos.

Key Compliance Requirements
To qualify for the statute’s liability protections, property owners must substantially implement the following measures:
1. Security Enhancements

Cameras: Install systems at entry and exit points that record and retain footage for at least 30 days.

Lighting:

Parking lots must have a minimum lighting intensity of 1.8 foot-candles per square foot at 18 inches above ground from dusk until dawn or controlled by photocell technology.

Walkways, laundry rooms, common areas, and porches must also be well-lit.

Locks:

Each dwelling unit door must have a 1-inch deadbolt lock and a peephole or door viewer.

Windows, sliding doors, and non-community doors must have locking devices.

Pool Security: Install locked gates with key or fob access around pool areas.

2. CPTED Assessment
By January 1, 2025, property owners must complete a Crime Prevention Through Environmental Design (CPTED) assessment conducted by:

A law enforcement agency, or
-
A certified Florida CPTED Practitioner.
Property owners must remain in substantial compliance with the recommendations outlined in the assessment.

3. Employee Training

Provide crime deterrence and safety training to all current employees by January 1, 2025.

New employees must complete training within 60 days of hire after the effective date.
